The Desert tortoise …
The Desert tortoise (Gopherus agassizii) does hibernate and are federally listed as threatened. Sulcata tortoises do not hibernate. Wild desert tortoises are illegal to keep, sell, collect, etc. If you rescue a tortoise (from a legit rescue) or if one has lived in your yard before the laws took effect, then they are considered to be legally “grand-fathered” and can be legally kept.
Dessert tortoises …
Dessert tortoises do not hibernate. It sounds like this one may have an upper respiratory infection. It could be mucus covering is face. A sick tortoise or turtle tends to keep it’s eyes closed. Maybe there is a rescue (SPCA) facility that can come provide aid. Regardless, this tortoise needs medical attention ASAP.
Some States may …
Some States may require permits to own this type of exotic.Sulcata tortoises ARE endangered in Africa and not permitted to be sold from Africa for the pet trade.Captive bred sulcatas are plentiful and the exotic rescue and rehabilitation facilities are full of these tortoises.People buy them without doing their research first. They are small and cute in the pet stores and the uneducated buyer does not realize that they grow to 100 pounds eat and poop like horses and will tear up your backyard.

I have a dessert tortoise from ma and pa~there are 2 babies about 1and1/2 and 2 about 2 and 1/2 yrs. It is the 2 and 1/2 yr. old I’m concerned with. I first thought he was hibernating out of season~he had what seemed to be a covering (mask) over his face~unable to see the mouth or eyes. I have been putting water on his face and in mouth~his eyes have opened but then shut again~I don’t know where to take him or what is wrong? I am in Garden grove ca and don’t drive~he is not mine~help please?
